Onward Transfer is one of the more important and contentious issues associated with the subject of Privacy. Ensuring that third parties with whom the enterprise shares Private Information respect and uphold the privacy of that information is the responsibility of the enterprise. For this reason, clear contract language that stipulates responsibilities and permissions in regards to Private Information is required.
This template includes sample third party onward transfer contract provisions, such as:
- Obligations and Activities of a Partner
- Permitted Uses and Disclosures by a Partner
- Obligations of the Enterprise
- Term and Termination
Enterprises are encouraged to review these contract provisions with legal counsel to ensure that they meet the requirements of any specific privacy legislation with which the enterprise must comply.
